📜 Customer Terms of Use

These Terms of Use apply to customers who purchase products or services from merchants on the AARIE.CA platform.
1. Agreement to Terms
By purchasing a product or service from any merchant on AARIE.CA ("Platform," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our platform.
2. Description of the Platform
AARIE.CA is a multi-merchant e-commerce platform that hosts independent merchant storefronts. We provide the technology infrastructure and payment processing, but each merchant operates their own independent business.
- Each merchant sets their own product offerings, prices, and policies
- Your purchase is with the individual merchant, not with AARIE.CA
- AARIE.CA facilitates transactions but is not responsible for merchant operations
3. Your Purchase Agreement
Your purchase agreement is with the individual merchant selling the product or service, not with AARIE.CA. When you complete a purchase:
- You are entering into a binding agreement with that merchant to pay the stated price
- You agree to the terms and conditions provided by that merchant at checkout
- You acknowledge that all product/service descriptions are provided by the merchant
- AARIE.CA is the technology platform; the merchant is the seller
4. Payment Processing
All payments are processed securely through Stripe, a third-party payment processor.
- We do not store or have access to your full credit card information
- By providing payment information, you authorize us to charge the displayed amount
- Payment disputes must be resolved with your payment provider or the merchant
- All prices shown include applicable taxes unless otherwise stated
- AARIE.CA is not responsible for payment failures or processing errors (contact merchant support)
5. Refunds and Cancellations
Refund and cancellation policies are set by each individual merchant.
- The merchant's refund policy is provided at checkout and in your order confirmation
- Some products may be non-refundable once purchased
- Some merchants may offer cancellations with refunds within a specified timeframe
- Refund eligibility is determined by the merchant's policy stated at time of purchase
- Refunds are processed to your original payment method within 5-10 business days
- AARIE.CA does not process refunds; contact the merchant directly with refund requests
Important: Please review the merchant's refund policy before completing your purchase. If you have questions, contact the merchant directly before purchasing.
6. AARIE.CA's Limited Liability
AARIE.CA provides the platform technology and payment processing services. To the maximum extent permitted by law:
- We are not responsible for the quality, completeness, or accuracy of product descriptions or services provided by merchants
- We are not liable for any indirect, incidental, special, or consequential damages arising from your purchases
- We are not responsible for merchant conduct, business practices, or customer service
- We are not responsible for technical issues, service interruptions, or data loss
- Our total liability for any claim is limited to the amount you paid for the product or service
- We are not responsible for disputes between you and a merchant
Some jurisdictions do not allow limitation of liability. To the extent permitted by law, the above limitations apply to you.
7. Merchant Responsibility
Each merchant is solely responsible for:
- Accuracy of product descriptions and pricing
- Quality and legality of products and services
- Customer service and support
- Fulfillment and shipping of orders
- Compliance with laws and regulations
- Refund and cancellation policies
- Any disputes with customers
AARIE.CA is not responsible for any of these merchant responsibilities.
8. User Responsibilities
By using our platform and purchasing, you agree to:
- Provide accurate information during registration and purchase
- Keep your account information confidential
- Use the platform only for lawful purposes
- Not engage in fraud, harassment, or unlawful activity
- Respect intellectual property rights of merchants and AARIE.CA
- Comply with all applicable laws and regulations
- Not reverse-engineer, decompile, or attempt unauthorized access to systems
9. Intellectual Property
All content on the AARIE.CA platform, including designs, logos, and text, is the property of AARIE.CA or its respective merchants.
- You may not reproduce, distribute, or republish any content without express permission
- Merchant products and descriptions are their intellectual property
- Commercial use, copying, or distribution is strictly prohibited
- You may not use our name or logo without permission
10. Disputes with Merchants
If you have a dispute or complaint about a merchant's product or service:
- Contact the merchant directly using the contact information provided in your order
- Give the merchant reasonable time to resolve the issue (typically 5-10 business days)
- If unresolved, disputes can be escalated to your payment processor (Stripe) or appropriate legal channels
- AARIE.CA may assist in mediation but is not responsible for resolving merchant disputes
11. Platform Availability
AARIE.CA provides the platform on an "as is" basis. We do not guarantee:
- Uninterrupted access or availability of the platform
- That the platform will be free from errors or bugs
- That merchant storefronts will remain active or available
- Performance or compatibility with all devices or browsers
We reserve the right to perform maintenance, updates, or take services offline with reasonable notice.
12. Prohibited Activities
You agree not to:
- Use the platform for illegal purposes or to facilitate illegal transactions
- Harass, abuse, or threaten merchants or other customers
- Engage in fraudulent activities (false chargebacks, identity fraud, etc.)
- Attempt to access unauthorized areas or other users' accounts
- Upload malware, viruses, or harmful content
- Post misleading or false reviews or product information
Violations may result in account suspension or legal action.
13. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any legal action or proceeding must be brought in the appropriate courts of Canada.
14. Changes to Terms
We reserve the right to modify these Terms of Use at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the platform following any changes constitutes your acceptance of the new terms.
15. Termination of Access
We reserve the right to terminate or suspend your access to the platform if:
- You violate these Terms of Use or our policies
- You engage in fraudulent or unlawful activity
- You harass or abuse others on the platform
- We determine it is necessary for legal, security, or operational reasons
Termination will not result in refunds unless otherwise required by law.
